1. Acceptance of Terms

By accessing or using services provided through topnotchservers.net, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not access or use our services. These terms constitute a legally binding agreement between you and TopNotchServers.

We reserve the right to modify these terms at any time. Continued use of our services after changes are posted constitutes acceptance of the modified terms. Material changes will be communicated via email to the address associated with your account.

2. Service Description

TopNotchServers provides premium cloud server hosting, dedicated infrastructure, managed services, NVMe storage solutions, DDoS protection, and white-glove support. Our platform is designed for business-critical workloads requiring the highest levels of performance and reliability.

Service specifications, including compute resources, storage allocations, network capacity, and available features, are described on our website and within the client portal. We may update, modify, or discontinue specific features with reasonable notice.

3. Account Registration

You must provide accurate, current, and complete information during registration and maintain the accuracy of such information. You are responsible for maintaining the confidentiality of your account credentials, including passwords and API keys.

You are solely responsible for all activities that occur under your account. You must notify TopNotchServers immediately of any unauthorized use of your account or any other security breach.

4. Acceptable Use

You agree not to use TopNotchServers services for any unlawful purpose or in violation of applicable laws and regulations. Prohibited activities include but are not limited to:

  • Distributing or hosting illegal content, malware, or phishing materials
  • Sending unsolicited bulk email (spam) or operating open relays
  • Engaging in resource abuse, including cryptocurrency mining without prior authorization
  • Attempting unauthorized access to other systems or networks
  • Conducting denial-of-service attacks or network scanning of third parties
  • Violating intellectual property rights of third parties

Violation of this policy may result in immediate suspension or termination of services without prior notice.

5. Service Level Agreement

TopNotchServers guarantees 99.99% network and infrastructure uptime, measured on a monthly basis. Uptime is calculated excluding scheduled maintenance windows, which are communicated at least 48 hours in advance.

In the event that uptime falls below the guaranteed threshold, eligible customers may request service credits proportional to the duration of the downtime. Credit requests must be submitted within 30 days of the incident.

6. Payment Terms

Services are invoiced on a monthly billing cycle. Payment is due within 14 days of the invoice date. All prices are stated in USD and are exclusive of applicable taxes unless otherwise specified.

Failure to make timely payment may result in suspension of services. TopNotchServers reserves the right to charge interest on overdue amounts at a rate of 1.5% per month, or the maximum rate permitted by law, whichever is lower.

7. Data Protection

TopNotchServers is fully committed to compliance with the General Data Protection Regulation (GDPR) and applicable data protection legislation. All customer data is stored exclusively in European data centers with enterprise-grade security measures.

Data is encrypted both at rest and in transit using industry-standard encryption protocols. We maintain strict access controls and conduct regular security audits.

8. Limitation of Liability

To the maximum extent permitted by applicable law, TopNotchServers' total aggregate liability shall not exceed the total fees paid by you during the twelve (12) months immediately preceding the event giving rise to the claim.

In no event shall TopNotchServers be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill.

9. Termination

Either party may terminate this agreement by providing thirty (30) days' written notice. TopNotchServers reserves the right to terminate services immediately in the event of a material breach of these terms.

Upon termination, you are responsible for exporting your data prior to the effective termination date. Data will be retained for 30 days following termination, after which it will be permanently deleted.

10. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions.
